Daniel's Home Inspections agrees to conduct a home inspection for the purpose of informing
(client) ______________________________________________________ of major visual deficiencies in the condition of the property at _______________________________________________________________for a fee of $__________.
Client "authorizes (initial) ______" "does NOT authorize (initial) _____" inspector to release Inspection Report information to agent/representative.
Confidential Report: The inspection and report are performed and prepared for the exclusive use of the client. The client promises not to disclose any part of the inspection report to any other person except for the following: one copy may be provided to the current seller/buyer of the property as part of this transaction only, and one copy may be provided to the real estate agent and/or bank or other lender for use in the client's transaction. The written report will include only the following inspection items:

*Attic *Air Conditioning *Heating *Electrical *Kitchen *Bathrooms
Inspection Limitations: It is understood and agreed that the inspection will be conducted of readily accessible areas of the building and is limited to visual observations of apparent conditions existing at the time of the inspection only in accordance with American Society of Home Inspectors (ASHI) standards of practice. Latent and concealed defects and deficiencies are excluded from the inspection. Equipment and machinery will not be dismantled. This is not an inspection to determine compliance with governmental codes and regulations of any kind. The Client will hold harmless Daniel's Home Inspections for any defects that are not apparent from visual inspection.
Specific Exclusions of Inspection
a. Neither the inspection nor the report are intended to address the possible presence of, or danger of any potentially harmful substances and environmental hazards including but not limited to radon gas, lead paint, asbestos, urea formaldehyde, toxic or flammable chemicals and water and airborne hazards.
b. This is not a termite inspection. A qualified termite specialist should conduct such an inspection.
c. Also excluded are inspections of swimming pools, wells, security systems, central vacuum systems, water softeners, sprinkler systems and, fire and safety equipment; including fire alarms, however, smoke alarms are operated if not connected to a Alarm Monitoring Service.
Inspection Not a Warranty or Guarantee: The inspection and report are not intended to be used as a guarantee or warranty, expressed or implied, regarding the adequacy, performance or condition of any inspected structure, item or system. Furthermore, Daniel's Home Inspections is not an insurer of any inspected conditions.
Disclaimer of Liability for Damages or Injuries: The parties agree that Daniel's Home Inspections and its employees and agents assume no liability or responsibility for the cost of repairing or replacing any unreported or undetectable defects or deficiencies, either current or arising in the future, or for any property damage, consequential damage or bodily injury of any nature.
Partial Invalidation: The Client and Inspector agree that should a Court of Competent Jurisdiction determine or declare that any portion of this contract is void, voidable or unenforceable, the remaining provisions and portions shall remain in full force and effect for no more than 1 year.
Applicable Law: All questions pertaining to this Agreement; its validity, construction and administration, shall be determined in accordance with the laws of the State of Arkansas.
